Responsible for content under §18(2) MStV: Vladimir Ivanov, address as above.
These Terms govern your use of the Android and Wear OS application Wear Audio
Recorder (package com.rimidalv.dictaphone, the “App”) and the transcription
service provided through it (together, the “Service”). Our
Privacy Policy forms part of these Terms.
If you do not agree with these Terms, please do not use the App.
2. What the App does
The App records audio on your phone and on a paired Wear OS watch, stores the recordings locally, and lets you organise, play and share them. Optional features let you copy recordings to your own Google Drive or Dropbox account, and convert a recording into text using a speech-recognition service.
The App is provided in a free version and a paid full version. Transcription time is sold separately.
3. Your account
Most of the App works without any account. You only need to sign in with a Google account to use transcription, because your balance of transcription time is tied to that account.
You are responsible for keeping access to your Google account secure. You may sign out at any time in the App under About → General → Transcript. To have your account and the data held with it deleted, contact us at binom.mobile@gmail.com.
4. Age
You must be at least 16 years old to use the transcription feature and to make purchases, or have the consent of a parent or guardian. The App is not directed at children under 13.
5. Purchases, prices and how billing works
All purchases are made through Google Play. Google is the seller of record and your contract of sale for the payment is with Google. Prices shown in the App include VAT where applicable.
Transcription is billed per second of audio actually processed, deducted from the balance you have purchased. If a transcription fails through no fault of yours, we do not charge for it; if time has already been deducted in error, contact us and we will restore it.
Purchased transcription time does not expire on a fixed date, but it is tied to your account and has no cash value. It cannot be transferred to another person.
6. Right of withdrawal for consumers in the EU
If you are a consumer in the EU, you normally have 14 days to withdraw from a contract for digital content without giving reasons.
However, when you buy transcription time and ask for it to be made available to you immediately, you expressly consent to us beginning performance straight away and you acknowledge that you thereby lose your right of withdrawal once performance has begun (Art. 16(m) of Directive 2011/83/EU; §356(5) BGB).
In practice: the right of withdrawal lapses for the portion of transcription time you have used. For unused time, contact us — we will handle refund requests reasonably, and in any case refunds for Google Play purchases are processed through Google's refund procedure.
To ask about a refund, write to binom.mobile@gmail.com or use Google Play's own refund process.
7. Your recordings and your responsibility
Your recordings and transcripts are yours. We claim no ownership over them and we do not use them to train models or for any purpose other than delivering the feature you asked for.
Recording other people. Laws on recording conversations differ from country to country and are strict. In Germany, recording the non-publicly spoken word of another person without their consent is a criminal offence under §201 StGB. You are solely responsible for ensuring that your recordings are lawful and that you have any consent required — both for making them and for uploading them for transcription.
You agree not to use the Service to process content that is unlawful, that infringes someone else's rights, or that you have no right to submit. We may suspend access to the transcription service if we have reasonable grounds to believe it is being used unlawfully or abusively.
8. Availability and accuracy
We aim to keep the Service available, but we do not guarantee uninterrupted operation. Transcription depends on a third-party speech-recognition provider and may be unavailable or degraded at times.
Speech recognition is automated and will contain errors. Speaker labels are an estimate. Do not rely on a transcript where accuracy matters without checking it against the audio.
A transcript is delivered to your device once and saved inside your recording file. We do not keep a copy: if the recording file is deleted, replaced or re-encoded, the transcript goes with it, and we cannot provide it again.
9. Our intellectual property
The App, its source code, design and trade marks remain our property or that of our licensors. Nothing in these Terms transfers those rights to you. You may not decompile, reverse-engineer or redistribute the App except to the extent that mandatory law permits it (in particular §69e UrhG).
10. Third-party services
Google Drive, Dropbox, Google Play and Google Maps are operated by third parties under their own terms and privacy policies. We are not responsible for them. Connecting the App to those services is your choice.
11. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and to the extent we have given a guarantee.
For slight negligence we are liable only where we breach a material contractual obligation — an obligation whose fulfilment is essential to performing the contract and on which you may reasonably rely — and in that case only for foreseeable damage typical for this type of contract.
Any further liability is excluded. This does not shift the burden of proof to your disadvantage and does not affect your mandatory statutory rights.
We are not liable for the loss of recordings. The App is a recorder, not a backup service. Keep your own copies of anything important.
12. Statutory rights
If you are a consumer, you have statutory rights in respect of digital products (§§327 ff. BGB). Nothing in these Terms limits those rights.
13. Changes to these Terms
We may change these Terms where there is a valid reason — for example a change in the law, in the Service, or in the third-party providers we rely on. We will publish the new version at rimidalvv.com/war/terms_and_conditions and, where the change materially affects you, tell you in the App in advance. If you do not accept a material change, you may stop using the Service and ask us for a refund of any unused transcription time.
14. Termination
You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the transcription service for a serious breach of these Terms, after warning you where that is reasonable and practicable. If we terminate without your fault, we will refund any unused transcription time.
15. Governing law and jurisdiction
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
If you are a consumer habitually resident in another EU Member State, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence (Art. 6(2) Rome I). You may bring proceedings in the courts of your place of residence.
16. Consumer dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (§36 VSBG). This does not affect your right to go to court or to complain to a supervisory authority.
17. Severability
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is unaffected.
